Why do you leave out turning over the server to the FBI, have them analyze the server and release all of those containing any government business?
The taping system was set up by government, in a government building, for the purpose of recording government business. The Supreme Court was clear why it allowed this government recorder and tapes to be released pursuant to the subpoena, and later the courts clearly established the precedent that even personal information on a government taping system in a government building belongs to the President and his estate. Hillary Clinton did not have a government server, but a personal server. The server was not in a government building, but in her personal home. The server set up in her home was primarily for her personal use. She turned over pursuant to Regulations copies of any government business which was on her personal property. She complied with the regulations, and could wipe her hard drive any time she pleases.
As to your second argument which is to turn the server over to the FBI, that would usually be the decision of the judge who would be doing an in camera examination of the item subpoenaed to decide which forensic experts would be utilized to determine if there was business records still remaining on a personal server, however the precedent of SOS is well established by Colin Powell whose hard drive was cleaned and had no data to turn over to the State department.........not only personal information was wiped, but State department information was forever wiped.......and not one word from anybody that either his decision was unethical or a violation of the regualtions.....they were not........it was his personal server and if the government wants to control government emails there is a very simple solution. All government emails must utilize a government server, but in the absence of this law......not regulation, government information will be on personal servers and as such that information could be lost, intentionally or by accident, which makes personal server use a very poor government policy and one which should be changed.
