Had it been a white person I feel confident they would have been detained for resisting arrest without violence and not complying with a uniformed officer's instructions.
Absolutely NOT....there were no exigent circumstances and he had every right to question the bad stop which in fact as I predicted was exactly that. She NEVER had a conflict on those plates, and I hope somebody investigates her claim of the same. When he clearly said he will give his DL to the supervisor he had not refused compliance but clearly qualified compliance where he thinks an officer is acting without authority. She was. The supervisors arrive as she is screeching in the background alternatively with the driver and a bystander. It took little time for them to discover it was a bad stop, as they scrambled to try to find anything to justify this bad stop.....but at that point it would be thrown out of court because she had articulated why she stopped the man......the supreme court has been clear on auto stops and fishing expeditions.
Now, how would I handle an agitated driver who believes I have wrongfully stopped him and has asked for a supervisor. What every well trained officer would do. "Sir, remain in your vehicle, and I will return to my squad and call for my supervisor" I would let the situation not escalate, and I would take control. This video of the stop is a perfect training tape on how not to make a stop.
I do agree there was Nothing racial about this stop, by the officer, or did the driver verbalize the same. It took the racist mob to be incensed thahe a black man was firm in exercising his rights, that a white woman was the officer, and that it was a black man who was an elected official. I could even understand if the anger revolved around undue influence where the driver said..."I am the County commissioner and you better get your act together".....not once did the driver play the commissioner card. No it took a mob action on the newspaper forums to draw out every racist to bring race into this discussion. Reread Linda's letter very carefully. There is no ambiguity. We know what happened to Emmit Till when it was thought a 15 year old black teenager had whistled at a white woman, and we saw the lynch mob make this about race. The truth is I would do what I do with every person who thinks they are going to take control of a situation......engage my brain.....fall back on my training.....return to the squad.....and let them stew........and then if he was a real jerk, I would give a wink to the van driver taking him back to the jail to give him a baltimore ride in the van. This was about a bad stop, lack of training, and an officer who has no business being on the street. If folks think anybody in his district saw it as the white lynch mob did......well ask Emmit Till's mother why she buried her son in an open casket.
