there has been much debate over whether she actually violated federal law. But according to both legal analysts who appeared on Fox News’ The Real Story with Gretchen Carlson Wednesday afternoon, Clinton is in the clear.

“I’m going to say no, because at the time she did what she did when she used her own personal email, the law was very nebulous,” former prosecutor Jonna Spilbor said in response to Carlson’s question about Clinton breaking the law. “It didn’t say you couldn’t use your own email, it said any government use of email had to be preserved. So what did she violate?” she asked. As long as Clinton can still retrieve the emails in question, Spilbor said, “There’s no law broken.”


And after that Gretchen and Jonna Spilbor did a terrorist fist bump!

It is too funny how the sheep puke out misinformation after being fed the same from Fox. My first post did not get excited about this as a legal issue, rather a simple security issue. Best practices have now been codified and make sense, but the Republicans are so desperate and have no platform, they can only create smoke and mirrors hoping the American people are as dense as a post. Based on the number of people who posted that this was illegal, they do seem to be connecting with cognitive challenged individuals.

Sorry, having been in public service for many years militarily and on the civilian side, the email rules are clear and they haven't changed since everyone got access to tech and email accounts. You don't handle public business "in the dark". The issue is what she says she might have saved when she is FORCED to turn over docs and what she really did save/delete. We know the Clinton clan can lie and obfuscate with the best of them. It's safe to say she is a criminal along the lines of Richard Nixon now.

A forensic computer expert can determine if the emails have been deleted. If a sophisticated deletion and recopying to a new hard drive was attempted, the forensic expert will be able to determine that in fact a new hard drive has been installed, but the deleted emails could never be found. If after examination of the server it is determined that a new hard drive was placed in the computer, that is a violation of the law and she could be prosecuted. So this is a tempest in a teapot. No law broken. No proof that the server used by the Clintons was less secure than a government server, and absolutely no proof of destruction of emails, which can EASILY be proved by forensic experts. This issue is entirely for stupid people.

Now is it good governmental practices. No, but the regulations have changed since she left office and that is a good thing.
