Sgt. Bowe Bergdahl, who was released by the Taliban last year in exchange for five prisoners, is being charged with desertion, retired Lt. Col. Tony Schaffer told Bill O’Reilly on “The O’Reilly Factor” Monday.

Mr. Shaffer, who now works for the London Center for Policy Research, said two separate military sources have confirmed to him that Sgt. Bergdahl’s attorney has been given a “charge sheet,” listing out the articles of the uniform military code that have been violated.

Semi-sane Markle carefully crafts his opportunity to condemn Obama and our government for getting Bergdahl free of his captors. But the facts are, Bergdahl was an American soldier who was a prisoner of war. The U.S. government had a responsibility to get him free of his captors if and when the opportunity presented itself.

Bergdahl's alleged desertion which may have contributed to his capture, is ANOTHER legal matter.

The government (headed by America's first black President) was correct in securing Bergdahl's release. And it's equally correct in charging the soldier with desertion, now that preliminary investigations are complete.

No doubt Semi-sane Markle will now race to his cut-and-paste file for another cliched response -- his normal retort when his argument has failed.

Betgdahl is a traitor regardless of what color the
cOWH is at the time. I think we should turn him over to the parents of the dead soldiers who were killed in a SAR attempt to find him. That wouid be perfect justice.

True, it was the right thing to trade 5 miserable low lifes for the return of an American, regardless of the circumstances surrounding his capture. We need to get rid of those Gitmo idiots anyway - why not get something in return? The desertion charge may never see the light of day because it's more of a political matter now than legal but Bergdahl is done in the military and will always be remembered as a deserter during war.

Maybe those parents could boil him slowly on camera, screams and all, to be presented as a TV special program from FOX News. In the background, you and Hannity could be shown laughing. Would that satisfy you?

Tell me, what's the real difference between Bergdahl who couldn't live with what America was doing in Afghanistan, and the hundreds of fellow soldiers who didn't desert, but who did their patriotic duty and then came home and committed suicide?

American soldier returned home safely......or would you like the Jessica Lynch story?


Initial official reports on Lynch's capture and rescue in Iraq were incorrect. On April 24, 2007, she testified in front of Congress that she had never fired her weapon, her M16 rifle jammed, and that she had been knocked unconscious when her vehicle crashed. Lynch has been outspoken in her criticism of the original stories reported regarding her combat experience. When asked about her heroine status, she stated "That wasn't me. I'm not about to take credit for something I didn't do... I'm just a survivor."

One witness account claimed that the Special Operations Forces had foreknowledge that the Iraqi military had fled a day before they raided the hospital, and that the entire event was staged, even going so far as to use blanks to create the appearance that they were firing.

In the initial press briefing on April 2, 2003 the Pentagon released a five-minute video of the rescue and claimed that Lynch had stab and bullet wounds, and that she had been slapped about on her hospital bed and interrogated.Iraqi doctors and nurses later interviewed, including Dr. Harith Al-Houssona, a doctor in the Nasirya hospital, described Lynch's injuries as "a broken arm, a broken thigh, and a dislocated ankle". According to Al-Houssona, there was no sign of gunshot or stab wounds, and Lynch's injuries were consistent with those that would be suffered in a car accident, which Lynch verified when she stated that she got hurt when her Humvee flipped and broke her leg. Al-Houssona's account of events was later confirmed in a U.S. Army report leaked on July 10, 2003.

Lynch faulted the U.S. government for creating the story as part of the Pentagon's propaganda effort.  Lynch claimed, concerning the media and the Pentagon: "They used me to symbolize all this stuff. It's wrong. I don't know why they filmed [my rescue] or why they say these things." She also stated "I did not shoot, not a round, nothing. I went down praying to my knees. And that's the last I remember."

The same media which is making an American soldier a villain for the small bus crowd.......negotiate for the release of American servicemen.....bad negotiations.....too funny.....hero or villain so far from reality in fantasy land.

Nothing.....this was a routine success for the President bringing home an American serviceman......simple really. Now the media doing the reverse Jessica Lynch story.....now that is special for special people.

The men who were beheaded were journalists there of their own volition. Bergdahl was ordered to serve in Afghanistan and as an American serviceman, our government had the responsibility of doing whatever was necessary to free him and bring him home. Stop playing stupid Pkrbum. It's beneath you.

Army: Bergdahl reports are untrue, no decision made

The Army says there is no truth to media reports claiming a decision has been made to charge Sgt. Bowe Bergdahl with desertion.

The Army continues to review the case against Bergdahl, said Paul Boyce, a spokesman for Forces Command, on Tuesday morning.

In a report Monday citing two anonymous military sources, retired Lt. Col. Tony Schaffer told Fox News' "The O'Reilly Factor" that the Army plans to charge Bergdahl with desertion. Schaffer also told the outlet his sources confirmed to him that Bergdahl's lawyer has been given a charge sheet.

No charge sheets were available Tuesday, and Boyce said he is unaware of any charge sheets being issued against Bergdahl, adding that the Fox News story "seems to be speculative in nature." Bergdahl's attorney Eugene Fidell declined to comment. NBC News, citing an anonymous senior defense official, is also reporting a desertion charge is coming, possibly within the week.

Gen. Mark Milley, commanding general of Forces Command, "is reviewing now the Army's facts and findings to determine, impartially, any appropriate next steps and possible actions," Boyce said.

Milley is "actively reviewing the case," he said. "No decision's been made."

There is no timeline for when Milley must make a decision.

Milley received the Army's investigation Dec. 22, Boyce said.

Bergdahl, 28, disappeared from Combat Outpost Mest-Lalak in Paktika province, Afghanistan, on June 30, 2009.

He spent five years as a captive under the Taliban before he was freed in a May 31 prisoner swap that also freed five Taliban leaders from the U.S. military prison at Guantanamo Bay, Cuba.

He is now assigned to a desk job at U.S. Army North at Joint Base San Antonio-Fort Sam Houston, Texas, while he awaits the outcome of the Army's review.

The Army has declined to release any details of the six-month investigation into the circumstances surrounding his disappearance.

Then-Spc. Bergdahl was accused of leaving his patrol base alone and intentionally before he was captured by Taliban insurgents in 2009.

A prior investigation of Bergdahl's disappearance — conducted in 2009 long before his return — found that some members of his unit believed Bergdahl left his patrol base alone at night at least once before and returned safely.

As the general court-martial convening authority, Milley has several courses of action, from no further action against Bergdahl to court-martial.

The case presents a challenge for the Army's leadership, which has to decide whether to punish a soldier who spent five years as a prisoner of war or essentially overlook the allegations of misconduct that surrounded his disappearance.

What's your problem War Hero? The issue about whether Bergdahl is going to be charged with desertion or not, is evidently undecided. If charges are brought, he'll be tried. If convicted he'll be punished.

If that isn't good enough for you, move to another country where they don't have a functioning legal system.
