WASHINGTON — BP is asking the U.S. Supreme Court to hear its challenge of the settlement agreement that’s forcing the oil company to reimburse businesses deemed hurt by the massive 2010 Deepwater Horizon spill in the Gulf of Mexico .

BP said Monday that it wants the Supreme Court to review its claim that the settlement process is rife with fraud. The company argues that it’s been ordered to pay “hundreds of millions of dollars – soon likely to be billions – of fictitious and inflated losses.”

BP so far has been on the losing end in court, and a federal appeals court yesterday refused to reconsider its earlier ruling in support of the settlement.

BP signed the settlement agreement two years ago but it’s turning out far more costly than the company expected. BP has responded with a legal and public relations offensive against the settlement, claiming that businesses are getting money without being hurt by the spill.

The courts have ruled, though, that the settlement agreement never required businesses to offer proof that their losses were directly caused by the oil spill . Instead, according to legal analysts who have tracked the case, the payments are based on a formula that takes into account the business’ distance from the spill and compares its revenuesin certain months before and after the spill.

BP argues that the settlement is being misinterpreted.

“No company would agree to pay for losses that it did not cause, and BP certainly did not when it entered into this settlement,” the oil company said Monday.

Yep and all the rashes, respiratory problems, joint problems, and deaths......who do those people go to............? The more things change, the more they stay the same. They poison the Gulf and give the illusion that things are back to normal to cut down their exposure under the settlement agreement, and now after poisoning the entire Gulf region, they want to claim fraud. The only fraud committed was the that the dispersants were diluted and harmless, and that clean beaches matter more than people's health........this will prove to be the biggest crime in American history.......and just like the banksters and wall street who stole trillions and nobody got prosecuted.....millions of Gulf residents will suffer health issues for multi generations without any type of recourse......simple criminals......

The whole reason they settled the way they did, was because it allowed them to avoid the very real possibility that juries would award astronomical awards to a variety of those affected while much of the country was still very angry about the spill, a situation whereby their eventual outlay would have undoubtedly been many times larger.

They shouldn't get to turn around now that most business have recovered, and public anger has subsided, and say "you know what, we really don't want to pay these people over here, because, look, their claims are kind of ridiculous, even though that's what we agreed to.....".

That bullshit is the sort of "heads we win, tails you lose" nonsense by which corporations like to play.

I guess we're going to find out just how eager the SCOTUS is to worship at the altar of capitalism.

When people start dying......they will argue intervening causes, and not our problem. The politicians were so happy to get free money for their pet projects they were bought off cheaper than a street hooker, and the business community got money, but the little guy......as usual their families will get sick, and they will not get one cent. Of course Hallmark is the new BP spokesman and he thinks everything is hunky dory. Evil or Very Mad Evil or Very Mad Evil or Very Mad
