JANUARY 14--Enraged that a disabled Walmart shopper in a motorized scooter was trying to purchase 22 items in a 20-items-or-less express line, a 77-year-old Florida man allegedly battered the victim with his metal shopping cart, according to cops who arrested the senior citizen on a felony charge.

The bizarre confrontation at the Punta Gorda store began Saturday evening when John Malherbe was unloading items in the express lane, according to a Charlotte County Sheriff’s Office report. The 67-year-old Malherbe was seated in an “electric shopping cart,” which held his walking cane.

Malherbe told deputies that as he placed his purchases on the checkout counter, William Golladay, 77, stood behind him counting the items. “When the count exceeded 20, Golladay began yelling at him that he had too many items and told him he couldn’t use that register,” Malherbe recalled.

After the two senior citizens exchanged words, Golladay initially retreated to his own shopping cart. But he then resumed yelling and approached Malherbe. “Golladay then intentionally pushed the metal shopping cart into Malherbe’s right elbow causing pain,” investigators reported.

Walmart managers then escorted Golladay out of the store, but he returned and walked toward Malherbe “with both fists raised.” Store workers again interceded and steered Golladay outside, where he was subsequently interviewed by a deputy. Golladay was “uncooperative and was ranting about how the man in front of him was in the 20 item express lane attempting to purchase over 20 items,” a deputy reported.

Malherbe, who was “shaking and upset” when interviewed by law enforcement, said he was “experiencing some pain,” but declined medical treatment.

Golladay, seen in the above mug shot, was arrested for battery on a person 65 years or older and booked into the Charlotte County jail on the felony rap. He was released the following day after posting $2500 bond, and is due for a February 10 arraignment. (2 pages)

They charged him with a felony......what fricking idiots.......we are living in a police state. This should have been a misdemeanor battery, and just because the statute says you can enhance charges, some folks need to use some common sense....

OK, Mr Oat. Tell me why the law is one the books. Don't castigate the cops for doibg their job. Don't like the law, then form an action committee to have it repealed. In a DV, if the cop sees a mark on any party, someone is going to jail, regardless od how the mark got there.

OK, Mr Oat. Tell me why the law is one the books. Don't castigate the cops for doibg their job. Don't like the law, then form an action committee to have it repealed. In a DV, if the cop sees a mark on any party, someone is going to jail, regardless od how the mark got there.

Prosecutors have discretion when authorizing charges. There are at least 5 charges which could have been authorized in most states for this type of petty misdemeanor battery, and age is a mitigating factor. Comparing this to a DV is absurd because the risk of another battery occurring is statistically insignificant where statistically DV lead to repeat risk to the victim. To answer your question as to why a law is on the books is because we elect people to office who propose silly legislation because people generally feel insecure and want to be tough on crime, but the cumulative effect of this over the last 40 years is a police state where common sense and proportion have been thrown out the window and small minded folks think that criminalizing everything is an answer to all our problems when in fact it is rapidly becoming THE problem.

There was a time in this country when much of our behavior was regulated by the community and members of the community who used peer pressure and shunning to get compliance with standards of behavior. The guy being verbal about the extra items is entirely appropriate behavior as is talking to someone who is cutting in line. Today we have allowed the criminal justice system to over expand and interject criminal sanctions where community sanctions were effective and the cost to society was far less. Any unauthorized touching which is a battery could have been handled by an officer asking the patron if he wanted to press charges, and then using common sense and the array of appropriate charges which do not involve a felony charge for this type of behavior. The person authorizing these charges should have spent 90 days in jail.......I think common sense would rapidly return to the system.

I would have pushed off the scooter and tossed the extra items.

I would have taken the extra items off, smiled and said " I am sorry". Then I would punch the wrong pin number in about 15 times, Change cards and repeat, asked for a price check, Get cash back, then say I did not want it, Then say the total is wrong and ask the cashier to call for the manager.

Yep, just an average day for Hallmark at the checkout counter.....if it was only intentional.......I think I have been behind you at Walmart when you ask for the price check on your depends, and then turn to me and ask me to read your pin number off your forearm where you have written it with black magic marker because you forgot your glasses, and then ask the cashier if somebody could help you find your car in the parking lot.
