Nope......the Supreme Court will have to tell us what is constitutional. There is a split decision in the lower courts, and the law must be determined by the Supremes......you again are cherry picking........this basically comes down to periods when congress is not in session, or is the proper time in January between congresses.......a tempest in a teapot.....and by the way....Presidents going all the way back to George Washington have made these appointments, and to highlight President Obama.....is silly....it is a straight up constitutional question......and one reviewing court has broken with precedent for over 200 years.....the Supremes will get it right.

Nope.....smart republicans understand things.....the crazies.....well they need some help....so they listen to absurd sources and do not have balance. Its your choice. I choose intelligence and facts. Sometimes they are with President Obama, and sometimes they are not..........to be able to discern the difference is important.

That will be one of many issues the Supreme Court will review. Clearly, once a year these appointments will be easy to do when congress breaks for the year......the intra breaks have a split of authority on appeals courts and quite honestly, I will be reading this carefully in the next few weeks, but this will be complex because both parties have used strategies to create a sham in session illusion, .......and again both parties have done this.......It will be interesting to see how the court rules, but to come to the conclusion that one court makes the rules in split lower court decisions.....well I think we had these discussions on the health care bill......deja vu.

Didn't Bush make recess appointments, too? John Bolton, the radical neocon who would never have been confirmed by the Senate, was appointed by Bush to be UN Secretary during a recess.

Edited: Recess appointments by the last 3 Presidents:

Bill Clinton: 139

George W. Bush: 171

Barrack Obama: 32

...It seems like Bush went whacky with recess appointments, while Obama has been very reserved with them. This thread is muchado about nothing....

No, you're wrong again.

BOTH parties have not this. This time President Barack Hussein Obama made the appointments while Congress was in session. President Obama pretty much figures that the Constitution applies to other people.
