Yes. The Supreme Court has never issued a Subpoena to my knowledge. The Supreme Court is rarely a court of first impression, and it is a court which reviews a lower court's determination. Actually, the character assasination of Bush was much worse. We know he sucked as an F-104 pilot, he was accsued of AWOL, he was a partier in college and we even know that he had "average" grades with a C average.

We don't know anything about Obama during his youth because all of that has been locked up and made confidential. What does Obama have to hide? Lots I think.
