Irrelevant... if he plays judicial activist too it'll just get appealed. Guess how it'll end?

Do you really want us to guess how it will end?
Since it is stated specifically in the law that the papers requested MUST be turned over to the house, it will end badly for Trump.

And I will tell you why. Because John Roberts cannot be trusted by YOUR side to completely violate settled law. He will probably simply refuse to take the case and let the lower court rulings stand.
I'm not saying I love John Roberts, but he has surprised a lot of people a lot of times before, mostly in cases of settled law. This is also why I think all the pro-life activists need to sit down and shut up until they can get the court packed just a little more. Roberts is not going to overrule Roe V Wade.

That's exactly what I expect will happen. Let's see if we're right.

But as to whether or not Garland himself will hear the case - maybe, maybe not - and I'm thinking probably not.   From New York Magazine (BBM):

It’s possible that Garland may not hear the case, as the D.C. Circuit Court of Appeals has yet to announce which judges will make up the three-person panel that will decide the appeal. But supporters of the president shouldn’t expect Republicans’ past treatment of Garland to color any possible decision by his court: Prior to his nomination fiasco, the judge was known as a consummate pro revered by both parties for his methodical opinions.
