It was a fact driven lower court appeal decision. It can be appealed, but the killing of a dog in a white middle class suburb, compared to a gang house are different facts and different outcomes as the expectation concerning officer safety is different, so there is not a lot of precedent in this ruling beyond the very specific facts of this case.
