The judge wrote that the president’s action goes “beyond prosecutorial discretion.”

“President Obama’s unilateral legislative action violates the separation of powers provided for in the United States Constitution as well as the Take Care Clause, and therefore, is unconstitutional,” the judge wrote.

While certainly it is Conservative Activism from the bench, it is too soon to tell whether it will stick.

The judge pulled this ruling out of his hat. It isn't even related to the case he was trying. I'm guessing the whole idea was to fire up the media.

The judge is irrelevant. The Supreme Court in ruling that Az must issue driver's licenses to illegal aliens covered under prior executive orders makes it clear that the use of that executive power is NOT unconstitutional. The message is clear when they took Cert from the 9th on this issue......don't waste our time with political issues which are not justiciable.....congress work it out, but in the meantime.......AZ follow the law.......slam dunk for President Obama.

Wrong. It was not tangent. If the action by the President allowing through executive action non citizens to have rights which could only be granted by Congress, the Supreme Court would have no legal basis under a Mandamus ruling to force the State of Arizona to do something Illegal. I will let the slow catch up........this is a home run again for the President, and if someone thinks this is a question of intellectually being honest rather than a comprehension problem as to how the court takes Cert.....then I cannot spoon feed or help in changing diapers.
