If he took one step towards the officer outside of the car I could see it as justified.
It would depend on the distance. There are some pretty sophisticated software training protocols which try to work on what is reasonable. Of course in Men in Black.....you just shoot the little girl with pigtails.
The FBI is all over this. I was shocked when the doctor had no ballistics on the bullets which missed....they were many, and any attempt to do angles of entry she simply said we could not determine the height of the of the officer's gun when he left the squad which could better explain Michael's posture. I found it interesting on the Odonnell show when the armpit wound was described as glancing and direction was not determined. Most people have discussed a distance from 25 to 50 feet, but the doctor was very clear.....there was NOTHING in the autopsy which will give an exact distance, but the shots were not made immediately in the vicinity of the decedent.....she did not however quantify any distance.
