Did you ever get a copy of the arrest report?

Did you ever get a copy of the arrest report?

No. There is a reason why arrest reports and police reports are inadmissible in a court of law.

The arrest report included the medical summary of the child's injuries found during his emergency surgery by Dr. Pearson and the Pediatric Intensive Care Specialist Dr. Rex Northrup.

He continued his residency training in neurosurgery at that institution and completed a fellowship in Pediatric Neurosurgery at the University of Texas Southwestern Medical Center, Dallas, Tex. Dr. Pearson is board-certified in neurosurgery and pediatric neurosurgery.

Medical Experience
Prior to coming to Pensacola, Dr. Pearson served as an assistant professor of neurological surgery at Vanderbilt University Medical Center in Nashville, Tenn. for more than eight years and provided pediatric neurosurgery services at Monroe Carell Jr. Children’s Hospital at Vanderbilt for five years. Dr. Pearson is also a member of the Children’s Oncology Group.

Medical Interests
Dr. Pearson has special medical interests in all aspects of pediatric neurosurgery including brain tumors, epilepsy, and movement disorders. He is an expert in neuroendoscopy and in the multimodal therapies for hydrocephalus.

Why was it first degree murder and not involuntary manslaughter?

There will be a trial. That is good. The rush to judgment and the so called expert testimony will be challenged. We will see how well his resume holds up on cross examination..

Unintentional killing committed in the commission of an "inherently dangerous" felony, is treated as first degree murder in most states. I assume because it was an abusive act on a child.

Involuntary manslaughter is without malice.

Why was it first degree murder and not involuntary manslaughter?

Because this keeps a defendant in jail without bond. When you do not have causal connections, it is a known strategy to sweat the defendant. Thankfully there will be a trial where experts will have their opportunity.

If you did not attend her bond hearing, you have no idea why she is being held without bond.

The murder charge against a Milton day care provider has been upgraded again.
Thelma Denise Lowery had been charged with second degree murder, in the death of a 15 month-old boy.

Investigators say the child had injuries consistent with Shaken Baby Syndrome.

A Santa Rosa County grand jury has now indicted Thelma Denise Lowery for first degree murder.

The State Attorney's office says, if she is convicted as charged, she will face life in prison without parole.

That is the mayo put on the ham sandwich......now family and friends will see this family bankrupt, but they will get experts who will raise reasonable doubt, but it will cost them a hundred thousand dollars minimum. This family does not have that kind of money. If she is exonerated at trial, like so many all over this country, the baby will still be dead, and a horrible miscarriage of justice will have been perpetrated. If she is found guilty, the experts were right, or she did not have the resources to get a proper defense......my guess she will not have the resources of the state, and without her income the family is already in trouble. Thankfully an American trial usually gets it right.

No right thread. Did you notice the officer being charged immediately and his bond revoked? Did you notice the SA inviting him into the Grand Jury room to talk to the grand jurors about his views. Both cases are carbon copies.

Carbon copies?

Was Lowery acting in the line of duty? She over-powered a 15 month old. Massive head injuries do have immediate symptoms.

Yes, she thought there was an immediate danger to herself and the public from this child and she used deadly force......it makes about as much sense as shooting a man fifty feet away who is raising his hands and is unarmed, but Mrs. Lowery is not part of a protected class......volunteer fire folks just do not get in the club.
