Republicans Filibuster Constitutional Fix To Overturn Citizens United Tyvpi7yoaxwsjqlggrkk


Senate Republicans on Thursday blocked a vote on a constitutional amendment to overturn Citizens United and other Supreme Court rulings dating back to 1976 that invalidated restrictions on money in politics.

The party line vote was 54 in favor, 42 against, falling short of the 60 votes needed to defeat a filibuster and proceed to a final vote.

The Senate broke an initial filibuster on the measure on Monday. But many Republicans who voted to begin debate did not support the proposal and intended to ultimately block it. The procedural motion on Thursday means the Senate won't move to an up-or-down vote, where it was even likelier to fail because it needed a two-thirds majority to advance.

Senate Minority Leader Mitch McConnell (R-KY), a fierce opponent of campaign finance restrictions, blasted Democrats for bringing up the measure.

"I have to say it’s a little disconcerting to see the Democrat-led Senate focusing on things like reducing free speech protections for the American people," he said before the vote. "This is what they chose to make their top legislative priority this week. Taking an eraser to the First Amendment."

The proposal, offered by Sen. Tom Udall (D-NM), would amend the Constitution to restore the authority of Congress to establish campaign finance limits, the kind that were axed in the 2010 Citizens United v. FEC and 2014 McCutcheon v. FEC Supreme Court rulings. According to a Senate Judiciary Committee report this year, it would also overturn part of the landmark 1976 Supreme Court ruling in Buckley v. Valeo, which upheld campaign contribution limits but invalidated restrictions on spending in elections.

"Since the decision came down in 2010, our campaign finance system has been under siege, buried in billions of dollars from outside groups and super PACs," he said. "We have been fighting from day one to rid our political system of the poison of Citizens United. Folks want their senators to work together to find real solutions, not be bogged down in the endless gridlock of the Citizens United era."

Progressive activists have waged a concerted campaign for the constitutional amendment, which they view as a long-term goal. Despite defeat in the Senate, they characterized the vote as a major step forward for the cause, saying that it shows that Americans are fighting back.

The reason the Repukes let it go forward on Monday was to burn time so that the Senate couldn't hold votes on equal pay for women and refinancing student loans before the recess.

It does not matter. The number of senate seats up for grabs in 2016 are mostly Republican senators who are at risk. There is a very real possibility of close to 60 democratic senators after the 2016 election. The key is that the Republicans fall short of winning the senate back in 2014. If by some miracle which no one predicted the Democrats keep a three seat plurality, then a seven seat gain in 2016 is almost a given based on changing demographics.

In addition, there are smaller tactical steps which can be taken to address Citizens which do not require a Constitutional amendment. The Supreme Court in Citizens left the door wide open for Congress to act. They clearly said that congress could restrict money contribution based on corruption. The senate simply has to pass a bill which says that the payment of any money over say one million dollars into a political campaign where that entity, or contributors to that entity, have a financial nexus with the government and potential financial gain, must fill out campaign finance disclosures attesting to no known financial nexus. If they qualify for the same, their contribution could be unlimited.

So if Boeing donates two million to twenty US senators, and those senators vote a military purchase which is from Boeing, this would be prima facia corruption by statute. The bill will only require a rational basis for the restriction to just one million or whatever amount Congress chooses, and it would be hard to argue a compelling state interest standard when common sense understands pay to play. Citizens is not a license to steal. It has clear language which allows Congress to address issues dealing with corruption. Sadly, not enough people familiar with the decision understand the clear path which must be taken. The amendment to the constitution is a radical unnecessary solution. I would support the same, but it is road to a solution which would be like going to Maine from Pensacola by traveling to Houston, LA, Seattle, New Orleans, and then Maine......one is an easy direct route, and one is very difficult.

15k a month is only the start. Most work as lobbyist and bring in millions after they retire. The game is rigged. It is corruption. It is time to open the door which the Supreme Court has identified in Citizens. The American people need to take our country back from capital which is fungible, has no citizenship, and is selfish and will park that capital anywhere to get the highest return.......they have stole our industrial base and shipped 50k factories overseas, and those who craft our tax laws have been bought and paid.......the Macro corruption is obvious and documented.
