The Attorney General announced that the Department of Justice will engage in more civil-asset seizures, a practice many conservatives have recognized as a deplorable abuse.

This is a serious problem when just suspected criminals have their property seized. They've done this in Tx and New Mexico where people have had their life savings taken accused of having drug money.

My daughter does civil forfeiture currently for the SA. It bothers her that many of the people who are losing property are not connected with any conspiracy but simply are minor criminals who F'd up. In the old days bad cops would routinely steal from criminals, but now their departments get rewarded with more money by these civil forfeitures. Home rule municipalities in Illinois see this process as a way to take care of budget problems. They do not let the SA office prosecute the civil forfeiture, and let them do the criminal dui. They impound the car, and get 500 bucks to release it to the defendant pending a forfeiture hearing where they can either take the car, or accept money paid, or add on to the amount. I would have no problem if all the money went to the schools, but when they go to the people who are doing the forfeiture, it is no different than the old days where cops would just take things from offenders.

Jeff Sessions wants to expand the standing army. He needs to finance the same.

I know people who were law abiding poor people, who screwed up one time with a dui, and lost their car. By the time they were able to pay the city who was a home rule municipality, they had lost their job.

The war on citizen's property to keep the Sheriff of Nottingham and his henchmen on the government teat needs to be blown up with the drug war. It has become an obscene moral failure. Jeff Sessions and his desire to create strong slave militias must be fought at every turn.

It does not take a great deal of reading of history before you realize the compromises of our constitution dealt with keeping the institution of slavery alive in the colonies. The whole right to militias and the right to bear arms was the need to keep the slave population under control.

When the slaves were freed, it was short order to turn them into indentured servants as sharecroppers when Jim Crow and the KKK kept the same order of slavery. Economically exploited for a couple of hundred of years was not enough when in the fifties Jim Crow was attacked and equal protection of the law became the law of the land, as dixiecrats abandoned the democrats as they passed Civil Rights legislation, it became necessary for Nixon to execute the Southern Strategy and begin the war on crime and the war on drugs, which is dog whistle for the war on black and brown people neutering their political power and opportunity as standing armies formed across America to slow and hinder equal protection of the law.

Jeff Sessions is just a cog in the Southern Strategy, and in order for it to work the war on crime which has suddenly had bipartisan support for peace on crime and letting non violent drug offenders out of prison has scared the solid block of the south. So crank up the war on drugs. Take poor people's property. Do not be stupid in voter impediments with literacy tests and poll taxes, rather start a lie that in person voter fraud requires more restrictions on voting. None of this is hard to figure out. It is one continuous line of political and economic power from one region which economically depends on the exploitation and control of the former slave population.

If it was just Jeff Sessions, it would be easy, but it is an entire region which fights the federal government's attempts to enforce equal protection under the law. The moral issues never get addressed. How can a Southern Baptist Church put up a sign that says Christians vote for Trump. You can get that answer as soon as you understand why the Baptist Church in America split. Our problems are deep, and they are not being addressed.

Justice ends 'asset forfeiture' program

"The Justice Department announced on Friday that most police departments could not use federal law to seize property from individuals when they have no reason to believe a crime has been committed.

Attorney General Eric Holder said in an order that the department would, in most cases, no longer run a controversial “asset forfeiture” program.

Local and state law enforcement agencies will no longer be able to use the federal program that allowed them to easily seize and keep property they acquired through searches.
Under the program, police would seize property and then the federal government would “adopt.” The police department would keep a large percentage of the value of the property, and the Justice Department would keep the rest.

The order from Holder says that, in almost all cases, police agencies will no longer be able to seize property and forfeit it under the program. There will be exceptions for cases that involve public safety, including the seizure of firearms, ammunition, explosives and property involved in child pornography.

“Asset forfeiture remains a critical law enforcement tool when used appropriately — providing unique means to go after criminal and even terrorist organizations,” Holder said in a statement. “This new policy will ensure that these authorities can continue to be used to take the profit out of crime and return assets to victims, while safeguarding civil liberties.”..."

The federal law is only the tip of the iceberg. It is state and local abuses which get me crazy. Any home rule jurisdiction can make up to $500 for an alleged crime where the perp was in their car. A kid has two joints in a car after a search. There is a tow charge, the forfeiture charge, and the delay in the citizen getting their car back. The worst part is that they use these funds on the Sheriff of Nottingham and they write more and more forfeitures. People are tired of the standing army and like the American revolution where the abuses of that standing army caused open rebellion, expect the same. I have given the example of a small town which said enough, and the citizens stormed city hall and asked that the entire police force be let go and to start over with community policing where the police having no crime in their town was going after the kids of the citizens for no good reason. I have a friend whose son is now a college graduate with a family who constantly was being picked up for tic tac things like playing basketball in the park after 8pm or riding his bike on the wrong side of a small town street that has four cars a day pass on it. The arrogance of the chief when dealing with the parents where he basically told them.....I am in charge. Well when close to five hundred came to city hall, and city council people where shunned and the mayor who was a dentist in town had all the people stop coming to his practice, the guy who was in charge and his henchmen were gone. The citizens took control again, and the town worked better with fewer police and with the community cooperation.

Believe me when I tell you I've been through much, much worse, although I won't go into it here because it's personal...I will say that it has to do with the police practice of turning the worst of the worst drug abusers into confidential informants.
